Process for Municipal Bylaw Confirmation
Alberta Environment and Protected Areas’ Guide to Excluding the Domestic Use Aquifer based on Municipal Bylaws
In accordance with Environment and Protected Area’s Guide to Excluding the Domestic Use Aquifer (DUA) Based on Municipal Bylaws – 2022 (the Guide), this form is being submitted to obtain confirmation from The City of Red Deer that a bylaw exists that meets the intent and requirements outlined in the Guide.
This form does not acknowledge any other aspects regarding the condition of the site with respect to whether it meets Clauses (iv) through (vii) of the Guide or any other requirements for Tier 2 Pathway Exclusion under the Alberta Tier 2 Soil and Groundwater Quality Guidelines.
Instructions
- Complete The City of Red Deer Confirmation of Bylaw for the Purpose of Elimination of the Domestic Use Aquifer Pathway under Alberta Tier 2 Site Assessment – Pathway Exclusion Option Form (pdf)
- With the completed form, please provide a summary letter (prepared by and properly authenticated by a qualified professional) with, but not limited to, the following information for the site:
- Site address and confirmation that the site property boundary is greater than 300 m:
- inside The City of Red Deer’s incorporated boundary,
- from Red Deer River, Waskasoo Creek, and Piper Creek (source waterbodies), and;
- from any City of Red Deer potable water reservoir.
- Site owner/Person responsible (Representative and Company) including contact information (email & phone).
- Environmental consultant (Representative and Company) including contact information (email & phone).
- Summary of site conditions.
- Reason(s) the site is being submitted for confirmation of the municipal bylaw.
- Site figure(s) or Environmental Site Assessment (ESA) showing:
- current sampling information for soil and groundwater
- summary showing current understanding of the conceptual site model and
- summary of the current understanding of any contamination (including aerial extent of heavily impacted media) or contaminant plume associated with the site.
- A water well records search of, but not limited to, the most recent version of the Government of Alberta Water Well Information Database and a figure of the 300 m water well search radius of the source site.
- If data sources show a generalized location of a well (ie: centre of a quarter section or section), provide confirmation that the location of the well has been verified to not be within the 300 m buffer.
- If data sources indicate a water well or domestic use water source is located within 300 m of the source site, but it is suspected that the water well or source has been abandoned or decommissioned, provide verification from the well owner of the well’s status.
- Site address and confirmation that the site property boundary is greater than 300 m:
