Business Improvement Area Disestablishment

City Council has given first reading to a bylaw that would disestablish the downtown Business Improvement Area (BIA). Under provincial legislation, downtown levy payers must be given a formal opportunity to vote before Council can make a final decision.

An in-person vote will be held on Monday, March 16, 2026, to gather input from eligible Business Improvement Area (BIA) levy payers on the potential disestablishment of the BIA and Downtown Business Association (DBA).

The vote is a required step in the legislated process after City Council gave first reading to a bylaw that would disestablish the Business Improvement Area. In December, the DBA board formally requested that The City initiate disestablishment proceedings. Provincial legislation requires that affected levy payers be given the opportunity to vote on whether disestablishment proceeds.

Voting dates and location

Eligible voters may cast a ballot in person at the following times and location:

  • Advance voting: Saturday, March 14, 2026, from 10 a.m. to 4 p.m.
  • Voting day: Monday, March 16, 2026, from 10 a.m. to 6 p.m.
  • Location: Boardroom, Servus Arena, 4725 43 Street, Red Deer, AB T4N 6Z3

Who can vote

Each BIA taxpayer is eligible for one vote. A taxpayer is a person who operates a business in the BIA and is liable to pay the BIA tax. The businesses will designate their voting representative.

Identification requirements

In addition to providing photo identification proving their identity, voters are required to provide reasonable proof that they are the person selected by the business to vote on behalf of the business. This can be any documentation or verification that shows the individual operates the business or has been authorized by the business to be its voter.  

Reasonable proof might include:
 

  • corporate registry documents confirming a person’s authority
  • a person’s name being on the business license or a BIA tax notice
  • a motion or letter from a corporation’s board or the partners approving a person to vote
  • a letter (or email) from the taxable business, from a verifiable business contact (ideally on letterhead, or from a business email address), signed/sent by an owner director/officer, or partner, identifying the business and naming the individual who is selected to vote for that business 

A signed declaration is also required by each voter, confirming they are a taxpayer for that business and have been selected to vote for that business (and acknowledging it is an offence to make a false statement). 

All eligible businesses are encouraged to learn about the vote and make a plan to participate.

Results and next steps

Results of the vote will be announced on Monday, March 16, 2026, once all ballots have been counted and verified. The outcome of the vote will determine if disestablishment proceeds:

  • A majority vote which supports BIA disestablishment means City Council must proceed with adopting the disestablishment bylaw.
  • A majority vote which opposes BIA disestablishment means City Council cannot proceed. First reading of the bylaw will be rescinded, the BIA and DBA will remain legally in place, and City Council will be prevented from passing another BIA disestablishment bylaw for two years.
What this means for BIA taxpayers
  • The vote gives levy payers a direct and legally binding say in whether the BIA is disestablished. Each BIA tax roll is eligible for one vote.
  • Regardless of the outcome of the vote, The City is committed to maintaining essential downtown services and engaging businesses on future governance options.
  • The City will not collect a BIA levy in 2026.
Services and continuity during the process

The City is committed to service continuity, stability and transparency. Downtown programming, marketing and business support services are expected to continue without interruption. We are working closely with the DBA Board to ensure legislative compliance, continuity of operations, and clear communication with the businesses we serve.

First reading of BIA disestablishment bylaw - January 13, 2026

  • On January 13, City Council rescinded the 2026 DBA budget previously approved in November, approved a revised budget which reflects Council’s direction to align financial planning with the potential disestablishment of the BIA, and gave first reading to a bylaw to disestablish the downtown Business Improvement Area.
  • The revised budget prioritizes the continuation of essential downtown services while reducing new levy requirements and relies on the DBA society’s existing reserve funds to support an orderly wind-down of operations should disestablishment proceed. The City will not be collecting a BIA levy in 2026.
  • First reading does not make a final decision. It initiates a provincially legislated process.
  • The Downtown Business Association’s announcement does not override this legislative process.

What is the purpose of the DBA?

The Downtown Business Association (DBA) delivers services funded through a business tax, or levy, paid by businesses located within the BIA. 

What is the BIA levy? 

The levy is a business tax - a collective contribution made by every business within the Business Improvement Area (BIA). It ensures that the downtown core is consistently supported through advocacy, safety initiatives, beautification, marketing, and events. About 65% of the DBA’s budget comes from the levy, with the remaining 35% raised through grants and contracts. 

The levy is governed by the DBA Board of Directors, who approve the budget before it is presented to City Council. The levy is collected by The City of Red Deer based on each property’s net annual rental value assessment (NARV). 

Who can participate in the vote? 

Each BIA tax roll is eligible for one vote. The businesses will choose their representative. 

The BIA levy is a business tax, not a property tax - property owners and businesses who do not pay the BIA business tax are not eligible to vote.

Is there a minimum requirement for participation in the vote? 

No. Provincial legislation does not require a minimum level of participation or turnout for the vote to be valid. Instead, the process focuses on giving affected taxpayers the opportunity to approve or object to the proposed disestablishment within the legislated timeframe. 

The City will clearly communicate who is eligible to vote, how the vote will be conducted, and the applicable timelines. 

Are the results of the vote legally binding?

Yes. The result of the taxpayer's vote is legally binding under provincial legislation.

  • If a majority of eligible voters support disestablishment, City Council is required to pass the disestablishment bylaw within 30 days.
  • If a majority of eligible voters oppose disestablishment, first reading is rescinded, Council cannot proceed with the bylaw and is prohibited from bringing forward another bylaw to disestablish the BIA for at least two years. 

When will the results of the vote be announced?

Results of the vote will be announced on Monday, March 16, once all ballots have been counted and verified. The results will be posted to reddeer.ca/news.

How will The City ensure a consistent downtown experience during the transition? 

The City’s priority is to ensure continuity and stability downtown. We are working closely with the DBA Board and planning ahead to prevent service gaps and maintain a safe, welcoming downtown experience. 

Will services be disrupted? 

While the DBA will not have staff or an operating budget, The City is maintaining oversight to ensure continuity of essential downtown services during this transition period. The revised budget was developed specifically to avoid sudden disruption to services that support downtown cleanliness, safety and activation. 

Longer-term decisions about service delivery will be informed by the outcome of the levy payer vote and subsequent City Council decisions. The City’s intent is to provide stability for downtown businesses while respecting the legislated process and the direction provided by affected taxpayers. 

Will Downtown Red Deer gift cards continue to function? 

Yes, the cards will continue to function and there is no expiry date. Downtown Red Deer Gift Card is issued by Peoples Trust Company. Card funds are not insured by the Canada Deposit Insurance Corporation (CDIC). Funds do not expire, cards are non-reloadable and provide no cash access. Will there be a BIA levy in 2026?  

No. The City will not collect a BIA levy in 2026.

Under provincial legislation, The City is required to pass a BIA tax rate bylaw in the spring if a Business Improvement Area exists within the municipality. However, City Council has given first reading to a bylaw that would disestablish the BIA, which triggers a legislated process that must be followed.

If the disestablishment process is still underway when The City is required to pass its tax rate bylaw, City Council has the option to set the BIA levy rate at zero.
